MINUTES
OLD LYME PLANNING COMMISSION
THURSDAY, JUNE 14, 2012


PRESENT WERE:  Robert McCarthy, Chris Kerr, Steve Ross and Stephen Martino.


Vice Chairman McCarthy called the meeting to order at 7:00 p.m.

PUBLIC HEARING

WOODS OF OLD LYME (OLD LYME HEIGHTS) – PLACING A NOTICE OF RESTRICTION ON CONVEYANCE OR TRANSFER OF TITLE OF PROPERTY LOCATED IN THE PROPOSED WOODS OF OLD LYME SUBDIVISION

McCarthy noted that during the review process of the proposed subdivisions even though the application was never approved several engineering reviews, site meetings, and legal fees were incurred.  

Ross asked why the term Notice of Restriction was used rather than lien.  McCarthy stated it is a restriction on transfer or conveyance of title.  Ross asked why the amount of outstanding fees was not put in the Notice.  Groves noted that legal fees will still be incurred until the issue is resolved.  She also noted that the amount currently due was approximately $16,000.00.   Kerr stated the amount should be left open to avoid any further notices being required until the issue is settled.  

Ross stated he felt the notice should be more explicit stating that these fees must be paid before any property can be conveyed or transferred.  Groves also noted that a final document will prepared for both the Chairman of the Planning Commission and the Inland Wetlands and Watercourse Commission to sign and then will be recorded on the land records in the Town Clerks office.  

Chris Kerr made a motion to close the public hearing.  Steve Ross seconded the motion.  The motion passed unanimously.

MOTION TO AMEND THE AGENDA

Steve Ross made a motion to amend the agenda to include a vote on Placing a Notice of Restriction regarding the Woods of Old Lyme Subdivision.  Chris Kerr seconded the motion.  The motion passed unanimously.


PLACING A NOTICE OF RESTRICTION – WOODS OF OLD LYME SUBDIVISION

Chris Kerr made a motion to record a Notice of Restriction on conveyance or transfer on title of property owned by Woods of Old Lyme, LLC for the subdivision known as “Old Lyme Heights” which is located on 27 Old Stagecoach Road and 29-2 Old Stagecoach Road, Old Lyme due to unpaid fees incurred during the land use application process for the above referenced subdivision.   Stephen Martino seconded the motion.  The motion passed unanimously.

SUBDIVISION - BGP DEVELOPERS, LLC – 5-1 DAVIS ROAD

Steve Ross made a motion to receive the application and set the Public Hearing for the July 12, 2012 meeting for BGP Developers, LLC.   Chris Kerr seconded the motion.  The motion passed unanimously.

READING AND APPROVAL OF THE MAY MINUTES

Steve Ross made a motion to waive the reading and approve the minutes as submitted.   Chris Kerr seconded the motion.  The motion passed unanimously.
